Acceptance of terms
By downloading, installing, or using Air Cast: Remote & Stream (the “App”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, do not install or use the App.
These Terms form a binding agreement between you and the publisher of the App. They are in addition to Apple's standard Licensed Application End User License Agreement, which also applies to your use of the App.
License grant
Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on iOS devices you own or control, solely for your personal, non-commercial use.
All rights not expressly granted are reserved by us. You do not acquire any ownership interest in the App.
Eligibility
The App is intended for users aged 13 or older. If you are under the age of majority in your jurisdiction, you must use the App under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.
Subscriptions and one-time purchases
The App is free to install and offers certain premium features through an in-app subscription or one-time purchase (collectively, “Premium”). All purchases are processed by Apple via the App Store and are governed by Apple's terms.
Billing
- The price displayed in the App is the price charged by Apple to your App Store account in your local currency.
- Subscriptions automatically renew for the same duration at the then-current price unless cancelled at least 24 hours before the end of the current period.
- Renewal charges are processed within 24 hours before the end of the period.
Free trials
If a free trial is offered, your subscription begins when the trial ends unless you cancel before that time. Unused portions of a trial are forfeited when a paid subscription is purchased.
Managing and cancelling
You can manage or cancel your subscription at any time from Settings → [your Apple ID] → Subscriptions on your iOS device. Cancellation takes effect at the end of the current billing period; you retain access to Premium features until then.
Refunds
Refunds for App Store purchases are handled exclusively by Apple in accordance with Apple's refund policy. We are not able to issue refunds directly.
TV compatibility — important
Air Cast supports a wide range of TVs and casting receivers using standard protocols (DLNA / UPnP, Chromecast, AirPlay, Roku ECP, Fire TV, Apple TV Companion Link, and others). However, every TV brand and firmware release behaves slightly differently.
The App is not affiliated with, endorsed by, or sponsored by Apple, Google, Samsung, LG, Sony, TCL, Hisense, Amazon, Roku, or any other television or device manufacturer. Trademarks belong to their respective owners.
Your content
The App enables you to stream content from your own device to a TV on your local network. You retain all rights in the content you cast. We do not access, store, or transmit your media to any server we control.
You are solely responsible for ensuring that you have the legal right to cast or display the content you choose. You agree not to use the App to stream content that infringes the intellectual-property rights of others or violates applicable law.
Acceptable use
You agree that you will not, and will not allow anyone to:
- Reverse engineer, decompile, or disassemble the App, except where permitted by law;
- Modify, adapt, translate, or create derivative works of the App;
- Use the App for any unlawful, infringing, or fraudulent purpose;
- Attempt to access systems, accounts, or networks you are not authorized to access;
- Interfere with the integrity or performance of the App or our infrastructure;
- Circumvent in-app purchase mechanisms or premium feature locks.
Intellectual property
The App, including all software, design, text, graphics, logos, icons, and audiovisual content, is owned by us or our licensors and is protected by copyright, trademark, and other laws. The name “Air Cast” and the Air Cast logo are our trademarks.
Third-party trademarks, including but not limited to Chromecast, Apple TV, AirPlay, Fire TV, Roku, Samsung, and LG, are the property of their respective owners and are used solely for identification.
Disclaimers
The App is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
We do not warrant that the App will be compatible with every TV, network, or iOS version, or that it will meet your specific requirements.
Limitation of liability
To the maximum extent permitted by law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the App.
Our total aggregate liability for any claim relating to the App shall not exceed the greater of (a) the amount you paid us for the App in the 12 months preceding the claim, or (b) USD 50.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
Governing law and disputes
These Terms are governed by the laws of the publisher's principal place of business, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally shall be submitted to the competent courts of that jurisdiction, except where mandatory consumer-protection law of your country of residence provides otherwise.
Changes to these terms
We may revise these Terms from time to time. When we do, we update the “Last updated” date above. Material changes will be highlighted in-app. Your continued use of the App after a revision takes effect constitutes acceptance of the revised Terms.
